TERMS OF USAGE
ACCEPTANCE OF TERMS
eCareers Academy provides its service to you, subject to the following Terms of Use, which may be updated by us from time to time without notice to you.
When using particular eCareers Academy products and services, you and Terms of Use shall be subject to any posted guidelines or rules applicable to such services, which may be altered at Terms of Use’s option. All such guidelines or rules are hereby incorporated by reference into the Terms of Use.
GUARANTEE POLICY (for career counselling and career-life coaching programs)
eCareers Academy stands behind the quality and value of our programs.
We will provide a 100% refund of course fees (only) or counselling fees (only) when:
For Secondary School Programs:
We need to be informed in writing 5 days upon completion of the program. Upon receipt of your letter we will offer you additional services to address your issue (no additional charge) or refund what you paid for the program (your choice). Hence, there is NO RISK to you. We require that all manuals and printed materials are returned to us prior to refund.
For Adult Counselling Programs:
You need to inform us that our services are not meeting your needs no more than 50% through the program. We will refund to you that portion of the program which did not meet your expectation as determined by your own evaluation. Upon notification, we will offer you additional services to address your needs or a full refund of monies paid for the program in question. Hence, there is NO RISK to you. We require that all manuals and printed materials are returned to us prior to refund.
For Career-Life Coaching Programs:
Based upon a monthly retainer, you need to inform us in writing the reason that the program is not meeting your needs specifying the reasons why. Upon notification, we will offer you additional services to address your needs or a full refund of monies paid for the one (1) month of the program you have raised the concern. Hence, there is NO RISK to you. We require that all manuals and printed materials are returned to us prior to refund.
REFUND POLICY for products, training and accreditation services
Refund will only be provided under the following terms:
- No refund is possible for goods shipped unless the circumstance contravenes the laws of New South Wales, Australia; please ensure you select products carefully.
- Refund for counselling, training or accreditation programs requested 8 weeks before the commencement of the program will be cheerfully refunded with an administration fee of 25%.
- For international programs, refund for counselling, training or accreditation programs requested 8 weeks before the commencement of the program will be refunded with an administration fee of 50%. This reflects the higher costs associated with offering programs internationally.
- Request for refund under 8 weeks before the commencement of any training or accreditation course is not possible.
- All training or accreditation courses can be postponed with additional fees payable when you undertake the next training course. These fees will reflect the costs of catering and/or other on-costs associated with the training course.
- Any program that we cancel or postpone entitles you to a full refund of monies for that program.
eCAREERS ACADEMY PRIVACY POLICY
Registration Data and certain other information about you are subject to our Privacy Policy.
DESCRIPTION OF SERVICE
eCareers Academy currently provides users with access to a comprehensive repository of online and offline products and services that enable users to interact with a range of career and vocational related information and relevant materials.
Unless explicitly stated otherwise, any new features that augments or enhances the current services, including the release of new eCareers Academy services, shall be subject to this Terms of Use.
You understand and agree that all services are provided as they are and that eCareers Academy assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.
YOUR REGISTRATION OBLIGATIONS
No portion of the eCareers Academy products and services may be reproduced or copied without prior written permission from eCareers Academy. All rights reserved. Any copying, redistribution, or retransmission of any of the contents of this service, including the psychometric instruments, without the express written consent of eCareers Academy is strictly prohibited and legal action may be taken by copyright owners.
MEMBER ACCOUNTS, PASSWORDS, AND SECURITY
Upon completion of the Counsellor Accreditation and Registration process for eCareers Academy 's services, you will be allocated a username and password.
You are responsible for preserving the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to
- immediately notify eCareers Academy of any unauthorized use of your password or account or any other breach of security, and
- ensure that you exit from your account at the end of each session. eCareers Academy cannot and will not be liable for any loss or damage arising from your failure to comply.
PUBLIC CONTENT POSTED TO eCAREERS ACADEMY
With respect to all Content you elect to post, upload, input, provide, or submit to eCareers Academy 's services, you grant eCareers Academy the royalty-free, perpetual, irrevocable, non-exclusive, and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.
INDEMNITY
You agree to indemnify and hold eCareers Academy, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of your use of the eCareers Academy 's products and services and/or your violation of the Terms of Use.
NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, any portion of eCareers Academy 's intellectual property, 3rd party intellectual property and/or services, use of eCareers Academy 's services, or access to eCareers Academy’s services.
MODIFICATIONS TO SERVICE
eCareers Academy reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, eCareers Academy’s services (or any part thereof) with or without notice. You agree that eCareers Academy shall not be liable to you or to any third party for any modification, suspension or discontinuance of eCareers Academy’s services.
TERMINATION
You agree that eCareers Academy, in its sole discretion, may terminate your password, username, account (or any part thereof) or use of eCareers Academy’s services, and remove and discard any Content within eCareers Academy’s services, for any reason, including, without limitation, for lack of use or if eCareers Academy believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Use.
eCareers Academy may also in its sole discretion and at any time discontinue providing eCareers Academy’s products and/or services, or any part thereof, with or without notice. You agree that any termination of your access to eCareers Academy’s services under any provision of this Terms of Use may be effected without prior notice, and acknowledge and agree that eCareers Academy may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or eCareers Academy’s services. Further, you agree that eCareers Academy shall not be liable to you or any third-party for any termination of your access to eCareers Academy’s services.
eCAREERS ACADEMY'S PROPRIETARY RIGHTS
You acknowledge and agree that eCareers Academy’s services and any necessary software used in connection with eCareers Academy’s services contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through eCareers Academy’s services or advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws.
Except as expressly authorised by eCareers Academy or advertisers, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on eCareers Academy’s services or the Software, in whole or in part.
eCareers Academy grants you a personal, non-transferable and non-exclusive right and license to use its Software on a single computer; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to access eCareers Academy’s services by any means other than through the interface that is provided by eCareers Academy for use in accessing eCareers Academy’s services.
TRADEMARK INFORMATION
Careers Academy™, eCareers Academy logo & tag line, and other eCareers Academy logos and products and service names are trademarks of eCareers Academy. Without eCareers Academy’s prior permission, you agree not to display or use in any manner, the eCareers Academy Trade Marks.
GENERAL INFORMATION
The Terms of Use constitutes the entire agreement between you and eCareers Academy and governs your use of eCareers Academy’s products and services, superseding only by any License Agreement signed between you and eCareers Academy.
The Terms of Use and the relationship between you and eCareers Academy shall be governed by the laws of the State of New South Wales, Australia without regard to its conflict of law provisions. You and eCareers Academy agree to submit to the personal and exclusive jurisdiction of the courts located within the State of New South Wales. The failure of eCareers Academy to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of eCareers Academy’s services or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
The section titles in the Terms of Use are for convenience only and have no legal or contractual effect.
VIOLATIONS
Report any violations of the Terms of Use to eCareers Academy Support.
